2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 379 of the Indian Penal Code.
3. Prosecution case, in brief, is that on 25.07.2019 at about 7 AM, motorcycle of the informant, along with some important documents, got stolen by some unknown miscreants.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during course of investigation on confessional statement of co-accused Rupesh Kumar. No stolen motorcycle or documents have been recovered from conscious possession of the petitioner.
5. Learned A.P.P. for the State vehemently opposed
Patna High Court CR. MISC. No.77141 of 2025(2) dt.11-12-2025 2/2 the bail application.
6. Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P. S. Case No. 569 of 2019, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
