2. The petitioner seeks bail in a case registered for offence under Sections 328, 302 and 34 of the Indian Penal Code.
3. The prosecution story, in brief, is that on 24.03.2019 at 5.00 P.M., co-accused Subodh @ Golu took husband of informant from the house with him and when husband of informant returned home, he started vomiting and feeling anxiety and also stated that co-accused Subodh @ Golu, Kailu, Jyoti, Kari Devi and Randhir Kumar (petitioner) after assaulting him administered poison to him. With the help of villagers, informant's husband was taken to hospital but on the way, he died. The reason behind the occurrence is that informant's husband had purchased a Tempo and co-accused Subodh @ Golu wanted to grab the same.

4. Learned counsel for the petitioner submits that as per prosecution case, it was co-accused Subodh @ Golu, who took the deceased with him. At best, it is a case of 'last seen'. Specific accusation and motive is against co-accused Suboth @ Golu, who has already been granted bail by a coordinate Bench of this Court, vide order dated 23.01.2020 passed in Cr.Misc. No. 4552 of 2020 (Annexure P/3). Petitioner has got no concerned with the alleged offence and is in custody since 23.07.2025, having clean antecedent.
5. Learned A.P.P. for the State opposes the prayer for bail.
6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Hilsa (Nalanda) in connection with Chandi (Wena) P.S. Case No. 98 of 2019.
