The petitioners seek regular bail in connection with Baniapur P.S. Case No. 304 of 2014, registered for the offence punishable under Sections 341, 324, 307, 326, 504 and 302/34 of the Indian Penal Code.
The allegation is against the mother-in-law, wife of the brother-in-law and the brother-in-law, namely, Khalil Main who are said to have sprinkled kerosene oil upon the victim lady and had then set her on fire resulting in her death. The learned counsel for the petitioners submits that admittedly, neither in the F.I.R. nor during the course of the investigation, the petitioners have been alleged to have indulged
Patna High Court Cr.Misc. No.23326 of 2018(4) dt.02-07-2018 2/2 in the aforesaid act of pouring kerosene oil on the victim lady and setting her on fire. It is further submitted that the petitioners herein have been falsely implicated in the present case, they are having a clean antecedent and they are languishing in custody since 08.03.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioners on regular bail. Accordingly, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Judicial Magistrate, 11th, Saran at Chapra in connection with Baniapur P.S. Case No. 304 of 2014.
