The petitioner is languishing in custody since 14.7.2019 in a case registered for the offences punishable under Sections 304B/34 of the I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

The prosecution case is that the daughter of the informant namely, Kiran Devi was married with co-accused Raja Choudhary, the son of the petitioner on 5th March, 2017. For some time, the relationship between them was cordial but thereafter, further dowry demand was made and due to nonfulfillment of the same, torture was inflicted upon the victim. Ultimately, she was killed by the accused persons throttling on 14.5.2019.

It is submitted by learned counsel for the petitioner that there is no specific accusation against the petitioner and the petitioner claims to be residing separate from the husband of the

Patna High Court CR. MISC. No.72316 of 2019(2) dt.04-12-2019 2/2 victim. It is further submitted that the investigation has already been concluded. Statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP submits that the accusation is against the entire in-laws family members including the petitioner. Considering the thrust of accusation against the husband of the victim, the investigation being concluded, statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM- VI, Nawada in connection with Kashichak P.S. Case No. 73 of 2019.
