2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 337 and 379 of the Indian Penal Code.

3. The case of the prosecution, in short, is that the informant is the wife of the driver who had earlier trample down a child because of his negligent driving and that he was assaulted at the hands of petitioner and others.

4. Learned counsel for the petitioner submits that nature of allegation is general and omnibus. Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that number of accused persons is certain named persons and 40-5- unknown persons who have assaulted with lathi and iron rod to the husband of the informant. Patna High Court CR. MISC. No.85421 of 2025(2) dt.12-01-2026 2/2 submitted that other similarly situated accused persons have been granted anticipatory bail by learned Co-ordinate Benches vide Cr. Misc. Nos. 761 of 2019 and 15546 of 2019. Learned counsel for the petitioner has submitted that the petitioner is in judicial custody since 14.08.2025.

5. Learned Additional Prosecutor for the State has vehemently opposed the bail application of the petitioner and has submitted that the petitioner is having criminal antecedent of three cases.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Manpur P.S. Case No. 100 of 2018 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Nalanda at Biharsharif.
