The petitioner apprehends his arrest in connection with Muffasil P.S. Case No. 307 of 2019 registered for the offences punishable under Sections 30(a)/41(i) of the Bihar Prohibition and Excise, Act, 2016.

Learned counsel for the petitioner submits that there is recovery of 90 liters of liquor from the house of Chhotu Sah and 3.90 liters of liquor from the shop of son of the petitioner. Learned counsel for the petitioner further submits that there is no recovery from the conscious possession of the petitioner and the petitioner has got no criminal antecedent.

No.57 of 2020(4) dt.24-02-2020 2/2 In the facts and circumstances of the case, I am inclined to grant anticipatory bail to the petitioner, subject to deposit of Rs.5,000/- in the Juvenile Justice Fund of the State Social Welfare Department and on deposit of the aforesaid amount, in the event of his arrest or surrender before the court below within six weeks from the date of communication of this order, the court below shall release him on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II-cum-Special Judge, Excise Act, Begusarai in connection with Muffasil P.S. Case No. 307 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Nasimul/- U T
