====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-12-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 303(2), 89, 351(2), 352, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, petitioner no. 1 assaulted informant with lathi on her back and arms and petitioner no. 2 assaulted her with fist due to which she sustained injury.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. As per F.I.R., six persons, including these petitioners, are alleged to have assaulted informant but injury report does not corroborate the allegations. As per injury report, informant received three

No.77060 of 2025(2) dt.11-12-2025 2/2 injuries which do not come under the definition of injury since, injury nos. 1 and 2 are complaints of pain and injury no. 3 is Amenorrhea. It is further submitted that similarly situated coaccused person has already been granted anticipatory bail by coordinate Bench of this Hon'ble Court vide order dated 27.08.2025 passed in Cr. Misc. No. 56768 of 2025. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering the nature of accusation, injury, clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Sadar, East Champaran, Motihari in connection with Pipra P. S. Case No. 187 of 2025, subject to condition as laid down under Section 482(2) of the BNSS.
