1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of regular bail in connection with Falka P.S. Case no.495 of 2022 registered under sections 302, 307, 201 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the eight named accused persons and one unknown accused person brutally assaulted his friend leading to his death.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case due to previous enmity. The manner of occurrence is other than what

Patna High Court CR. MISC. No.83061 of 2023(2) dt.10-01-2024 2/2 has been narrated in the F.I.R. Even otherwise the allegations are general and omnibus in nature. Similarly situated co-accused namely Pradip Singh and one another have been enlarged on bail vide order dated 28.7.2023 passed in Cr. Misc. no.45463 of 2023. The petitioners are in custody since 16.9.2023 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation against the petitioners, grant of bail to the similarly situated coaccused vide order dated 28.7.2023, the petitioners being in custody since 16.9.2023 and chargesheet having been submitted in the case, the Court directs all the four petitioners to be enlarged on bail in connection with Falka P.S. Case no.495 of 2022 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar.
