Petitioner is an accused in a case registered for offence under sections 379, 411, 413, 414,120B and 34 IPC. Learned counsel for the petitioner submits that though the seizure list on the basis of which he is sought to be implicated in this case is dated 28.3.2017, whereas the FIR has been lodged much later on 27.9.2017, even as per the same, recovery is from near his house. He submits that petitioner has falsely been implicated in three cases after his arrest in K.Hat Police Station Case No. 469/2017 only on basis of suspicion. Petitioner is in custody since 9.10.2017.

In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be

Patna High Court Cr.Misc. No.23776 of 2018 (3) dt.23-05-2018 2/2 released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the FTC II, Purnea in K.Hat Police Station Case No. 691 of 2017, Sessions Trial No. 6 of 2018 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.

(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
