Petitioner is an accused in a case registered for offence under section 377 IPC and under sections 4 and 6 of the POCSO Act.

Learned counsel for the petitioner submits that it is a case of false implication and as the victim while playing in the orchard, jumped from the bunch of straw and fell on the small pieces of dried logs of wood.

This Court finds the investigation as well as the injury report corroborate the manner of occurrence as alleged in the FIR.

In view of the heinous nature of offence, I am not inclined to grant bail to the petitioner for the present. The

Patna High Court Cr.Misc. No.24094 of 2018 (3) dt.23-05-2018 2/2 prayer for bail of the petitioner is rejected. (Madhuresh Prasad, J) Shashi.
