The petitioner seeks regular bail in connection with Pipra P.S. Case No. 202 of 2017 for the offences punishable under Section 392 of the Indian Penal Code.

The allegation of the prosecution is that while the informant was going to Motihari on a hired pickup vehicle to purchase fruits, the accused persons came on red colour Pulsar motor cycle and on gun point took out Rs.60,000/- from the pocket of the informant and fled away.

The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case, but in order to show bona-fide he is ready to

Patna High Court Cr.Misc. No.24721 of 2018 (3) dt.05-07-2018 2/2 deposit a sum of Rs.60,000/- with the Najarat of the concerned Court. The petitioner is said to be in custody since 24.02.2018. Having regard to the facts and circumstances of the case, more particularly the fact that the petitioner is accused in three other cases of similar nature, I direct that the petitioner shall deposit a sum of Rs.60,000/- with the Najarat of the concerned Court, subject to the final outcome of the present case, whereafter he shall produce the receipt showing the deposit of such amount before the concerned Court i.e. the learned Court of Chief Judicial Magistrate, Motihari, East Champaran and the said learned Court shall release the petitioner on regular bail subject to such terms and condition as it may deem fit and proper to be imposed upon the petitioner.

The present petition is disposed of in the aforesaid terms.
