JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bikramganj P.S. Case No. 297 of 2019 registered for the offences punishable under Sections 341, 323, 307, 379, 353, 504, 506 of the Indian Penal Code.

At the very outset, it is informed that petitioner has already been released on police bail.

Accordingly, it is submitted on behalf of the petitioner that this bail petition may be disposed of in the light of dictum given in the case of Mahendra v.s State of Bihar reported in 2004(3) PLJR 491.

In view of the aforesaid submission, this petition stands disposed of with direction to petitioner to surrender before the

Patna High Court CR. MISC. No.74758 of 2019(6) dt.16-03-2020 2/2 court of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P.S.Case No. 297 of 2019 within six weeks from today and if petitioner does so and makes prayer for passing appropriate order in the light of decision rendered in Mahindra v.s State of Bihar ( Supra), the concerned court shall pass appropriate order in the light of above stated case.
