====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has prayed for bail in connection with Bhagwantpur P.S. Case No. 146 of 2019 registered for the offences under Sections 147, 148, 149, 341, 323, 307, 427, 504, 506 of the Indian Penal Code and Section 25 (1-b)a, 26, 27 of the Arms Act.

As per allegation in the FIR, the petitioner and others are said to have entered and cultivated the land of the informant. It is further stated that they fired indiscriminately. The petitioner along with co-accused Nandu Kewat, Ajit Sharma and Rahul Singh are said to be involved in firing.

It is submitted by learned counsel for the petitioner

No.74720 of 2019(2) dt.27-11-2019 2/2 that the petitioner is in custody since 16.09.2019 and that the case of the petitioner stands on similar footing to that of coaccused who has been granted bail vide order dated 22.10.2019 passed in Cr.Misc. No. 67213 of 2019 and vide order dated 04.11.2019 passed in Cr.Misc. No. 67047 of 2019. Learned A.P.P. for the State, however, vehemently opposed the prayer of the petitioner.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Kaimur (Bhabua), in connection with Bhagwanpur P.S.
