1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Sursand P.S. Case no. 674 of 2022 registered under sections 420, 406 and 379 of the Indian Penal Code.

3. As per the prosecution case, the informant states that the petitioner introduced him to co-accused Satyendra Kumar and Nagendra Kumar Sinha who took the informant's truck on rent with a promise to pay Rs.80,000/- per month. Though the rent for the same was paid for a month, however subsequently neither they have returned the truck nor have they paid the amount. It is for this reason that the FIR has been registered.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. Even as per the allegations in the FIR, the truck of the informant was taken on rent by the other two accused persons and the only allegation against this petitioner is of having introduced the informant to them. The petitioner is in custody since 12.7.2023 and chargesheet has been submitted in the case.

5. The application for bail is opposed by learned APP for the State who submits that the petitioner has several criminal antecedents against him.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having remained in custody for 9 months since 12.7.2023 and charge-sheet having been submitted in the case, the petitioner is directed to be enlarged on bail in connection with Sursand P.S. Case no. 674 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi.
