The petitioners are apprehending their arrest in connection with Pipra P.S.Case no.232 of 2017 , registered for offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner no.1 is of firing on the informant causing injury on her abdomen and against the petitioner no.2 is of assault by farsa on head causing injury. Submission of the learned counsel for the petitioners is that there was land dispute between the parties and there was no repetition of the gun fire. It is also made clear that the injury on the head was found to be simple in nature.
Patna High Court Cr.Misc. No.26013 of 2018 (3) dt.05-07-2018 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above so far petitioner no.1 (Manoj Mandal @ Manoj Kuamr Mandal) is concerned, I am not inclined to grant privilege of the anticipatory bail to the petitioner no.1, however, the petitioner no.2 (Kishore Mandal @ Kishore Kumar Mandal) is concerned let the petitioner no.2 in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Acjm IIIrd, Supaul in connection with Pipra P.S.Case No.232 of 2017 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is disposed of.
