ANJANA MISHRA ORAL ORDER 26-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 27.08.2019, in connection with Manjhi P.S. Case No. 249 of 2019 for the offenses under Sections 30, 30(g), 38(i), (ii) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recovery was not made from the conscious possession of the petitioner but from the pick-up van. The petitioner is merely driver of the vehicle in question. It is further submitted that coaccused Rajnish Kumar Mishra has already been granted bail by this Court vide order dated 23.10.2019 passed in Cr.Misc. No. 67740 of 2019. The petitioner has got a clean antecedent.

Case No. 249 of 2019.
