JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2019 The petitioner seeks regular bail in connection with Bheldi P.S. Case No. 81 of 2018, registered for offences punishable under Section 392 of the Indian Penal Code. Allegation as per F.I.R. is that while the informant was coming with his motorcycle, two motorcycle borne miscreants came and snatched his ATM card and other documents and one of them took away his motorcycle. Petitioner is not named in the F.I.R., later on he was arrested with looted motorcycle and his confession was recorded. Apart from that it appears that he is accused in seven other cases.
It has been submitted on behalf of the petitioner that only after arrest in the present case, he has been made accused in seven other cases and he has been custody for more than 16 months and except confession, there is nothing against the
Patna High Court CR. MISC. No.70724 of 2019(3) dt.20-12-2019 2/2 petitioner.
Learned counsel for the State opposed the prayer for bail and also submitted that he was apprehended in other case on the spot after occurrence, by the villagers. Having heard both sides, considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail.
This application is accordingly dismissed.
