The petitioners seek anticipatory bail in connection with Hajipur Sadar P.S.Case No. 404 of 2017, registered for offences punishable under Sections 147, 148, 149, 447, 343, 385, 307, 379, 435, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioners is that the petitioners and two other accused persons came to his house and demanded rangdari and later on, they went to the house of the informant and fired at him and also snatched Rs. 30,000/-. Submission of the learned counsel for the
Patna High Court Cr.Misc. No.24802 of 2018 (2) dt.09-05-218 2/2 petitioners is that there is no specific allegations have been attributed against the petitioners and the petitioners have no criminal antecedents.
Learned A.P.P. opposes the prayer for bail and submits that there is specific allegation against the petitioners. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioners, Accordingly, prayer of anticipatory bail is rejected with a direction to the petitioners that if the petitioners surrender before the court below within a period of four weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.
This application is accordingly dismissed.
