2. The petitioners apprehend their arrest in a case registered for the offence under Sections 409, 406, 420/34 of the Indian Penal Code.

3. It is alleged that informant was running CSP in

Patna High Court CR. MISC. No.82421 of 2024(3) dt.27-01-2025 2/3 order to provide banking services to villagers through State Bank of India in West Champaran, where petitioners were working as CSP operators. It is further alleged that some of the customers of CSP complained that their credit amount has not been deposited in account and old age pension amount has been withdrawn by illegal means and deposited in the account of other persons.

Learned counsel for the petitioners submits that as per F.I.R., though it is alleged that petitioners have misappropriated huge amount of villagers, but from perusal of paragraph - 45 of the case diary, it is apparent that petitioners have already deposited Rs. 17,19,000/- in the S.B.I. Kumarbag branch and concerned Branch Manager, vide letter dated 30.07.2024, has communicated to the I.O. of the case that the alleged money, which was deposited by petitioner (Sudarshan Kumar), has already been transferred in the account of concerned customers. Petitioners claim clean antecedent.

5. Considering the fact that alleged amount, which is said to have fraudulently withdrawn by petitioners, has already been deposited in the bank and same has also returned to concerned customers, the prayer for anticipatory bail of both petitioners is allowed.

Accordingly, let the above named petitioner (in both the cases), in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Sanichari P.S. Case No. 01 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
