Petitioner is apprehending his arrest in connection with Kadamkuan Ps Case No.525 of 2019 dated 11.8.2019 , registered for offences punishable under Sections 366 of the Indian Penal Code.

There is allegation against the petitioner of kidnapping of the grand daughter of the informant, who is minor. Submission of the learned counsel for the petitioner is that the allegation is false and concocted and she has solemnized marriage with the petitioner and she is aged about 21 years and he has annexed an affidavit of the Notary Public . Heard learned A.P.P. , who has opposed the prayer for bail on the ground that the girl has not been recovered.

No.73520 of 2019(2) dt.21-11-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular bail and the learned court below shall dispose of the application for bail of the petitioner and shall consider the statement recorded under Section 164 Cr.P.C., if any recorded by that time.

With the aforesaid direction, this application is disposed of.
