The petitioner apprehends her arrest in a case registered for the offence punishable u/s 80/ 85/ 115(2)/ 352/ 351(3)/ 3(5) of B.N.S, 2023 and 3/4 of D.P. Act.

Allegedly, all the F.I.R. named accused persons including the petitioner have killed the daughter of the informant due to non-fulfilment of demand of dowry.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. She has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The petitioner is the married nanad of the deceased who has been living with her husband and two children in Patna and has no concern with the
Patna High Court CR. MISC. No.82441 of 2024(2) dt.11-12-2024 2/2 affairs of the family of her parents or brother. Husband of the deceased is already under judicial custody since 28.10.2024. The allegation leveled against the petitioner is not specific rather general and omnibus in nature. Petitioner has no criminal antecedent as mentioned in para 3 of the bail application. 5.
Learned APP for the State opposed the prayer for bail. 6.
Having regard to the facts and circumstances of the case, and since there is no specific overt act attributed against the petitioner, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Thali P.S. Case No.217 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023.
