JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-02-2020 While the petitioner in this case is seeking a direction to the respondent authorities to take legal action against respondent nos. 6 & 7, this court finds no statement in the writ application that they are absconding. At the same time, learned counsel for the State has, on instruction, submitted that the investigation in the case is going on and on finding that the surgery of the patient was conducted in

Patna High Court CR. WJC No.22 of 2020(3) dt.05-02-2020 2/2 Sakshi Surgery Centre Sirhi Ghat, Bakhtiyarpur and not at Sai Nursing Home, as was alleged by the petitioner, the said case has now been transferred to the Bakhtiyarpur on 06.01.2020.

Taking note of the aforesaid developments where it transpires that investigation in this case is going on and on revelation of certain information the case has been transferred now to the Bakhtiyarpur Police Station and there being no statement that the respondent no. 6 & 7 are absconding, no direction, as prayed, may be issued by this Court. It is always open for the Investigating Officer to take appropriate steps and action as may be directed by the Supervising Authority of the case.

The Writ Application stands disposed of accordingly.
