JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-03-2020 The petitioner, who is the sister-in-law of the deceased, seeks bail in connection with Mufassil P.S. Case No. 371 of 2019 dated 06.07.2019 instituted for the offence under Sections 304(B) and 34 of the Indian Penal Code.

The petitioner is stated to be in custody since 26.08.2019.

From the perusal of the FIR, it appears that the deceased was found dead in her matrimonial home and a black mark was found on her neck, giving rise to the suspicion that she has been strangulated.

The allegation in the FIR is that all the accused persons including the petitioner pressed the neck of the deceased by a wooden article.

Learned counsel for the petitioner has

No.73616 of 2019(3) dt.06-03-2020 2/2 submitted that she along with her husband are separate in mess and business from the husband of the deceased and merely because it has been alleged in the FIR that the husband of the deceased had illicit relationship with the petitioner, that she has been made accused in this case.

The accusation against the petitioner is absolutely false.

Taking into consideration the nature of accusation against the petitioner, her gender as well as the period of custody, she is directed to be released on bail on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran (Bettiah) in connection with Mufassil P.S.
