The petitioner, being husband of the informant, is languishing in custody since 27.09.2019 in a case registered for the offences punishable under Sections 341, 323, 379, 498A, 504/34 of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act.

The prosecution case is that the petitioner forcibly performed marriage with the informant on 26.10.2018 but subsequent to the marriage, there was dowry demand of Rs.Two lakhs and a motorcycle and due to non-fulfillment of the same, she was being tortured and ultimately, the informant driven out from the matrimonial house.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.70852 of 2019(2) dt.27-11-2019 2/2 that the petitioner admits his marriage with the informant and frivolous accusation has been levelled since there was no question of making demand as there was love marriage between the petitioner and the informant.

Learned APP submits that the accusation is specific against the petitioner.

Considering the nature of accusation and period under custody, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 119 of 2019.
