Petitioner, already in custody, seeks bail in connection with Parbatta PS Case No.67 of 2018, registered under Sections 304(B), 201/34 of the Indian Penal Code.
Allegation in brief is that the informant's daughter was married with Rohit Kumar in the year 2017 and he along with his family members were torturing his wife for realizing further dowry and killed her when the demand was not fulfilled and the dead body was disposed of with the help of driver, the petitioner and his friends.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.25595 of 2018(2) dt.27-04-2018 2/2 petitioner is not the family member of the matrimonial home of the deceased rather he is the driver of the husband of the deceased and there is no allegation of making demand of dowry and torture against the petitioner except that he being the driver, he and his other friends had taken the dead body for cremation. Having considered the aforesaid facts and circumstances, petitioner Banty Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Khagaria in connection with Parbatta PS Case No.67 of 2018.
