2. This is the second attempt of the petitioner for prayer of regular bail. Earlier also, the bail of the petitioner was rejected vide order dated 08.11.2023 passed in Cr. Misc. No. 59654 of 2023.

3. The petitioner seeks bail in connection with S. Tr. No. 1157/2023, arising out of Tekari P.S. Case No. 456/2022, registered for the offence punishable under sections 302/201/34 of the Indian Penal Code.

4. As per the prosecution case, for selling the family land, the petitioner killed his 75 years old father by strangulating him. The informant of the case is wife of the petitioner.

5. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.82069 of 2024(2) dt.18-12-2024 2/2 though the charges has been framed on 24.01.2024 and two witnesses have been examined but thereafter, the informant is not appearing and is delaying the trial. The petitioner is in jail since 17.03.2023.

6. Considering the delay in trial and the observation of the Hon'ble Supreme Court in the case of X vs. State of Rajasthan 2024 SCC Online SC 3539, this application for regular bail is allowed.

7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned court of District & Addl. Session JudgeXV, Gaya in connection with S. Tr. No. 1157/2023, arising out of Tekari P.S. Case No. 456/2022, subject to the condition that the petitioner shall cooperate in the trial and shall be represented through his lawyer or himself on the date fixed in the trial.
