Petitioner's father died in harness while working as "Senior Accounts Clerk" in the Road Construction Department at Motihari and, consequently, thereto the petitioner had applied for appointment on compassionate ground.

It is submitted that petitioner's mother has also filed a representation for compassionate appointment of her only son, the present petitioner, but the same has not been considered till date. It is further submitted that on 31.01.2019, the respondent no. 3, Executive Engineer sent a letter no. 126 to the Superintending Engineer regarding appointment of the

Patna High Court CWJC No.23154 of 2019(2) dt.09-01-2020 2/2 petitioner but till date no action has been taken thereon and his case for compassionate appointment remains to be addressed. Considering the aforementioned facts and circumstances of the case, it is directed that the case of the petitioner be considered within a period of six weeks from today on receipt/production of a copy of this order. It is made clear that the respondents shall not delay the matter further as the very ratio of compassionate appointment is to mitigate the miseries of persons, who have been left high and dry due to the sad demise of an earning member of the family and it is not open to the respondents to sit on it considering that it is a welfare scheme.
