The petitioner seeks bail in G.R.P.S. Jhajha P.S. Case No. 47 of 2017 registered under Section 392 of the Indian Penal Code.

Two unknown miscreants are said to have robbed the cash, mobile and belongings of the informant and other commuters in the running train.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in this case at the instance of his enemies. He is not named in the F.I.R. He was not put on T.I.P. No incriminating article has been recovered from his possession.

No.28389 of 2018 (2) dt.09-05-2018 2/2 There is nothing in the record indicating the complicity of the petitioner in the occurrence barring confessional statement of coaccused Ajay Kumar Yadav. The petitioner has been languishing in custody since 27.11.2017. Said Ajay Kumar Yadav has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 78 of 2018 vide order dated 11.01.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rail Court, Kiul, Lakhisarai in connection with G.R.P.S.
