2. The present petition has been preferred for the following relief/s:

(i) to issue a writ of Mandamus/Certiorari or any other writ or writs, direction or directions commanding upon respondents authorities for quashing the order dated 26.09.2025 passed by Respondent no.4, Circle Officer, Masaurhi whereby and

Patna High Court CWJC No.19584 of 2025(2) dt.04-12-2025 2/3 whereunder Mutation Case No.2566/202526 has been allowed and Register-II has been updated in favour of Respondent no.5 with respect to the land mentioned in correction slip described at the end of order dated 26.09.2025, however, a Probate Case No.65/2025 has already been filed by the petitioners in the Court of Principal District Judge, Patna with respect to the same lands and during pendency of the Probate Case C.O. Masaurhi had no right to do mutation regarding the land in question;

(ii) to pass any such other order or orders as the Hon'ble Court may deem just and proper.

3. After some argument, learned counsel for the petitioner submits that he shall be moving before the Deputy Collector, Land Reforms, Masaurhi, Patna (respondent no.3).

4. Learned State counsel has no objection.

5. In that background, the writ petition is disposed of allowing the petitioner to approach the Deputy Collector, Land Reforms, Masaurhi, Patna (respondent no.3) in next four weeks.

6. If such petition is preferred, after noticing/ hearing all the parties, the matter shall be taken to its logical conclusion at an earliest.

7. The writ petition is disposed of with the aforesaid observation.
