JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Bahadurpur PS case no. 410 of 2017 instituted for the offences punishable under Sections 363, 366 A/34 of Indian Penal Code. The allegation is regarding the petitioner having enticed the girl to Delhi and kept her there, whereafter the girl was recovered from the village itself.
The learned counsel for the petitioner submits that firstly the victim girl, in her statement made under Section 164 Cr.P.C. has not made any allegation of sexual assault as against the petitioner herein and secondly, the girl is said to have gone to Delhi but was recovered from the village, hence the allegation
Patna High Court Cr.Misc. No.25498 of 2018 (4) dt.06-07-2018 2/2 does not appear to be correct. The petitioner is having a clean antecedent and he is languishing in custody since 20.01.2018. Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Darbhanga in connection with Bahadurpur PS case no. 410 of 2017.
