JUSTICE RAKESH KUMAR ORAL ORDER 03-05-2018 Heard Sri Ram Prawesh Kumar, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, who is in custody in connection with Banmankhi P.S. Case No. 14 of 2018, registered for the offences under Sections 304(B)/ 34 of the Indian Penal Code, 1860 and Section 3⁄4 of the Dowry Prohibition Act, 1961 has prayed for grant of bail.
By way of referring to the F.I.R., learned counsel for the petitioner submits that petitioner is the father- in- law of the deceased and in the F.I.R. only allegation was made against husband regarding demand of dowry. By way of referring to the statement made in paragraph no. 11 of the petition, learned counsel for the petitioner submits that husband of the deceased is already in custody.
Patna High Court Cr.Misc. No.26134 of 2018(2) dt.03-05-2018 2/2 Considering the fact that in the F.I.R. there was specific accusation against husband, who is already in jail, there is no reason to deny the prayer for bail.
Accordingly, let the petitioner Vijendra Yadav be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea / concerned court in connection with Banmankhi P.S. Case No. 14 of 2018.
