Petitioner seeks regular bail in connection with Special Case No.8228 of 2019, arising out of Nadi P.S. Case No.227 of 2019, for the offence punishable under Section 30(a) of Bihar Prohibition & Excise Amendment Act, 2018. The allegation against the petitioner is that the police recovered a total quantity of 200 litres of illicit liquor from the four plastic bags belonging to the petitioner. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case inasmuch as illicit liquor has not been recovered from the conscious possession of the petitioner and the bags do not belong to the petitioner. Patna High Court CR. MISC. No.70683 of 2019(2) dt.04-12-2019 2/2 standing on the road and the illicit liquor was kept near the road in bags and petitioner has been arrested. Learned counsel further submits that petitioner has got no criminal antecedent and he is in custody since 13.09.2019.
Having regard to the submissions made by the parties and taking into consideration the fact that petitioner has got no criminal antecedent and he is in custody since 13.09.2019, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No.8228 of 2019, arising out of Nadi P.S.
