2. The petitioner seeks regular bail in connection with Kanti P.S. Case No. 419 of 2023 dated 07.06.2023, lodged under Sections 302 & 34 of the I.P.C. read with Section 27 of the Arms Act.

3. As per the prosecution case, the F.I.R. has been lodged against 11 named accused persons. The accused Pintu Kumar and Raman Singh are the assailant of the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the antecedent of the petitioner is clean and he is in custody since 15.09.2023. He further submits that the other similarly situated co-accused Ram Kumar Sharma has been granted bail

Patna High Court CR. MISC. No. 84103 of 2023(2) dt.10-01-2024 2/2 by the Co-ordinate Bench of this Court vide order dated 10.10.2023 passed in Cr. Misc. No. 63339 of 2023.

5. Learned A.P.P. for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case, this bail application is allowed.

7. Let the petitioner above named, be granted bail only after framing of charge on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Muzaffarpur West in connection with Kanti P.S. Case No. 419 of 2023, subject to the condition that the petitioner shall co-operate in trial.
