====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 27-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner has prayed for bail in connection with Piro P.S. Case No. 412 of 2018 registered for the offences under Section 379 of the Indian Penal Code and Section 4/5 of Explosive Substances Act.

As per allegation in the FIR, incriminating articles were recovered from the shop of Rakesh Kumar, who is said to have taken the name of this petitioner and two others. It is submitted by learned counsel for the petitioner that the aforesaid Rakesh Kumar, on whose confession the name of the petitioner has transpired in the FIR, has already been enlarged on bail vide order dated 29.04.2019 in Cr.Misc. No.

Patna High Court CR. MISC. No.75678 of 2019(2) dt.27-11-2019 2/2 28136 of 2019. It is further submitted that the petitioner has no criminal antecedent and is in custody since 03.09.2019. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Bhojpur, Ara, in connection with Piro P.S.
