It has been submitted at the end of the learned counsel for the petitioner that Cr. Appeal (SJ) No. 2538/2019 has been dismissed under the guise of peremptory order dated 27.08.2019 due to noncompliance thereof. It has further been submitted that after going through the defect so pointed out by the office, from defect no. 5 to 8, are not at all relevant.

Gone through the same and, in the fact and circumstances of the case, Cr. Appeal (SJ) No. 2538/2019 is directed to be restored to its original status.

Consequent thereupon, Cr. Misc. No. 79433/2019 is allowed.
