11-07-2018 Heard Sri Bijendra Kumar Singh, learned counsel for the petitioner and Sri Jagdhar Prasad, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Sadar (Muffasil) P.S. Case No. 551 of 2017 registered for offence under Sections 302/201/34 of the Indian Penal Code, has prayed for grant of bail.

Learned counsel for the petitioner submits that there is no cogent material to connect the petitioner in the present case, however; petitioner has been made accused and thereafter, petitioner voluntarily surrendered on 17-10-2017 and he is languishing in jail.

Earlier, in this case, case diary was called for, which has been received. Besides this, a report from the court below

Patna High Court Cr.Misc. No.27084 of 2018(4) dt.11-07-2018 2/2 was also called for regarding the stage of the case, which has been received and kept at flag 'A'. The report dated 02-07-2018 sent by learned District & Sessions Judge, Purnea makes it clear that case is fixed for framing of charge.

Besides hearing, I have also examined the material on record and after going through the same, neither I am inclined to grant bail on merit nor there is any reason to pass favourable order, since case is already fixed for framing of charge. The prayer for bail stands dismissed.
