The petitioner seeks bail in Ramgarh P.S. Case No.285 of 2018, Gr. No.2667/2018 registered under Section 395 of the Indian Penal Code.

The learned counsel for the petitioner submits that petitioner is not named in the F.I.R.. Nothing has been recovered from the possession of the petitioner. Save and except the fact that the name of the petitioner surfaced in the case in the confessional statement of co-accused, there is no tangible material to show the involvement of the petitioner in the alleged road dacoity. Petitioner is in jail since 13.08.2019 and petitioner has not been put on T.I.P.

Learned A.P.P. also admitted the fact that petitioner

Patna High Court CR. MISC. No.71622 of 2019(3) dt.06-03-2020 2/2 has not been put on T.I.P. and save and except the fact that name of the petitioner surfaced in the case in the confessional statement of the co-accused, there is no tangible material against the petitioner.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Kaimur at Bhabua in connection with Ramgarh P.S. Case No.285 of 2018, Gr. No.2667/2018.
