Mr. Javeed Aslam, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-11-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Manjhagarh P.S. Case no. 310 of 2018, registered under Sections 147, 149, 323, 324, 308 and 504 of the Indian Penal Code.

The accusation is that informant Niraj Kumar Kushwaha had gone to watch procession of Mahavir Akhara, at that time, Parmeshwar Sharma, Narad Sharma along with 20 unknown came there and Parmeshwar Sharma gave Farsa blow at his head causing blood oozing injury and Narad Sharma caused injury through fist and slaps and snatched gold chain

Patna High Court CR. MISC. No.72291 of 2019(2) dt.18-11-2019 2/2 while the mob was raising alarm. At that time, Mithun Paswan, Vishal Prasad (Petitioner No.2), Ajay Kumar Sharma, Laddu Sharma, Ram Bali came having sharp cutting weapon in their hands to disburse the mob.

Learned counsel for the petitioners submits that the assailant of informant is Parmeshwar Sharma and Narad Sharma, which would appear from the F.I.R. and allegation against the petitioners and four others to disbursing of mob having sharp cutting weapon in their hands. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Gopalganj in connection with Manjhagarh P.S. Case No. 310 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
