Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code.
Patna High Court CR. MISC. No.71720 of 2019(5) dt.24-01-2020 2/3 Informant who is Uncle of deceased in his written complaint has stated that the marriage of his Niece Rubi Kumari was solemnized on 31.01.2019 with Tillu Kumar according to hindu customs and rites and thereafter she was being subjected to torture for non fulfillment of demand of Rs. 1 Lacs and without informing him she was cremated. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case as they are in-laws of the deceased. It has been further submitted that petitioner no. 1 is Father-in-law, petitioner no. 2 is Mother-in-Law, petitioner nos. 3 and 4 are Bhainsurs and petitioner nos. 5, 6 and 7 are Jethani and there is general and omnibus allegation against them. Petitioners have got no criminal antecedent.
Considering the aforesaid facts and circumstances of the case and the fact that petitioner nos. 2, 5, 6 and 7 are ladies,provisional bail granted to them vide order dated 20.11.2019 is hereby confirmed.
So far as petitioner nos. 1, 3 and 4 are concerned, after perusing the case diary and considering the gravity of offence, I am not inclined to enlarge them on bail. Hence the prayer for bail of petitioner nos. 1, 3 and
