1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 109(1) and 3(5) of the B.N.S., 2023.
3. Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that while is son was returning from a fair when Krishna and Surendra intercepted him and stabbed him causing injury on stomach and threw him on bank of a canal.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case during the course of investigation. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that

No.78715 of 2025(2) dt.04-12-2025 2/3 informant specifically alleges that Krishna and Surendra intercepted his son and stabbed him causing injury on stomach but then during the course of investigation, when the statement of the victim was recorded he stated that he was intercepted by the accused persons including the petitioner and Samir Khan stabbed him causing injury on stomach. It is next submitted that even presuming what has been alleged is true without admitting then petitioner is not alleged to have assaulted the injured by knife causing injury on stomach. It is reiterated and submitted that in the FIR specific allegation of assaulting by knife is against Krishna and Surendra as such it might be a possibility that during the course of investigation for ulterior reason other accused persons came to be implicated.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and taking into consideration the fact that petitioner is not named in the FIR and is not alleged to have assaulted, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand)
