JUSTICE SANJAY PRIYA ORAL ORDER 3/ 26-06-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in K. Hat (Madhuban) P.S. Case No.161 of 2018 instituted for the offence under Section(s) 306 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Purnea.

It is alleged in the written report that informant got information on his mobile that his son has committed suicide after hanging. The informant reached at the place of occurrence and in presence of police door was opened and he found his son was hanging. One suicide note of son of the informant was also found, wherein, it was written that he is committing suicide due

Patna High Court Cr.Misc. No.26370 of 2018 (3) dt.26-06-2018 2/2 to torture committed by the petitioner, who was Registrar of the College. The suicide note of the deceased is enclosed with the First Information Report.

Case diary has been received, wherein, it has come that the deceased has committed suicide due to torture committed by this petitioner.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
