Petitioner is apprehending his arrest in connection with Gaighat P.S.Case No.383 of 2018 , registered for offences punishable under Section 392 of the Indian Penal Code. As per FIR, there is allegation of snatching of Apache Motorcycle on the point of Pistol by three miscreants, apart from that cash of Rs.2,000/- and one mobile.

Submission of the learned counsel for the petitioner is that he has been made accused on the confessional statement of the co-accused and that co-accused has already been granted bail.

Heard learned A.P.P., who has opposed the prayer for bail stating that this is a case of robbery against unknown person, as

Patna High Court CR. MISC. No.74460 of 2019(2) dt.17-01-2020 2/2 such appearance of the petitioner is required for the purpose of T.I.P., as such the petitioner is not entitled for grant of anticipatory bail.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory to the petitioner, however, is is directed to surrender and pray for regular bail which will be considered by the learned court below on its own merit.
