2. The petitioner has prayed for bail in connection with Jhajha P.S. Case No. 378 of 2025 registered for the offence punishable under Sections 313, 331(4), 305, 317(2) of the B.N.S., 2023.

3. The case of the prosecution in short is that the petitioner, along with others, was caught red-handed committing theft. From the possession of this petitioner, also one mobile that was a stolen article was recovered.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

He also submits that in this case, co-accused namely, Pintu Kumar having similar nature of allegation has been granted bail by learned co-ordinate Bench of this Court vide order dated 03.12.2025 passed in Cr. Misc. No. 83264 of 2025. The case of this petitioner stands on similar footing. Petitioner is languishing in judicial custody since 05.08.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner has criminal antecedent of one case.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail with the condition that the petitioner will mark his attendance at the Jhajha Police Station on every Sunday of each month and default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 378 of 2025.

7. Accordingly, the bail petition of the petitioner stands allowed.
