The petitioner seeks bail in anticipation of his arrest in connection with Sasaram (Muffasil) P.S. Case No. 30 of 2018, dated 08.06.2018, instituted for the offences under Section 370(A) of the Indian Penal Code and Sectin 3 of the Prohibition of Child Labour and Regulation Act, 1986. The petitioner is said to be the owner of a sweet shop, where a 12 years old boy was employed as a labourer.

No.78791 of 2019(3) dt.06-12-2021 2/3 It has been submitted on behalf of the petitioner that initially a complaint also has been lodged against him vide Official Case No. 10 of 2018 in which he has been released on bail. Apart from this, it has been submitted that the victim/boy had come in search of food in the shop of the petitioner and the petitioner, taking sympathy at that boy, asked him to stay back and also offered him food. Merely because the petitioner had given shelter to a 12 years boy who had nowhere to go, he has been made accused in this case.

Regard being had to the background facts, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of three weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (Muffasil) P.S. Case No. 30 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
