2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 498A, 504, 506 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.
3. As per the prosecution case, there is allegation of commission of torture and harassment due to non-fulfillment of demand for dowry.
4. It is submitted by learned counsel for the petitioner that petitioner is brother-in-law of the complainant. Specific accusation is against husband of the complainant and there is general and omnibus allegation against this petitioner. Petitioner
Patna High Court CR. MISC. No.82595 of 2023(2) dt.18-01-2024 2/2 is separate in mess & property and has got no concern with the affairs of the complainant and her husband. Petitioner claims clean antecedents.
5. Learned A.P.P. for the State has opposed the prayer for grant of anticipatory bail to the petitioner.
6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.
7. Accordingly, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Naugachia, District- Bhagalpur, in connection with Naugachia (Mahila) P.S.
