08-05-2018 Heard Sri Bindeshwar Prasad Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, having clean antecedent, has prayed for grant of bail in Kudra P.S. Case No. 101 of 2018 registered for offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

At the very outset, learned counsel for the petitioner submits that petitioner has been implicated in the present case on the basis of confessional statement of co-accused. It has been argued that save and except confessional statement, there is no other material to show involvement of the petitioner. He further submits that in the case, recovery of about 87 liters of Indian make foreign liquor was shown from a mill of coaccused Madan Prasad and on the basis of statement of Madan

Patna High Court Cr.Misc. No.27702 of 2018(2) dt.08-05-2018 2/2 Prasad (co-accused), the petitioner has been made accused. Considering the nature of accusation, clean antecedent as well as the fact that petitioner has been made accused on the basis of confessional statement of the co-accused, let the petitioner namely Manoj Chaudhary be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Kaimur at Bhabua in connection with Kudra P.S. Case No. 101 of 2018.
