JUSTICE ASHUTOSH KUMAR ORAL ORDER 18-05-2018 The petitioner seeks bail in connection with Pasraha P.S. Case No. 11 of 2018, dated 04.02.2018, instituted for the offences punishable under Sections 147, 149, 341, 323, 379, 342, 504 and 506 of the Indian Penal Code.

About 20 quintals of fish which was kept by the informant for being sold in the market was taken away by the miscreants including the petitioner. Other belongings of the informant were also robbed.

Learned counsel for the petitioner has submitted that a false case has been instituted. In fact, there is a

Patna High Court Cr.Misc. No.26280 of 2018 (3) dt.18-05-2018 2/2 dispute with respect to the fishing rights and only because of that dispute, all persons belonging to one particular group have been named in the First Information Report. Nothing specific has been alleged against the petitioner and he is in custody since 20.03.2018. Earlier, the petitioner was made accused in three cases and in all such cases, he is on bail.

Regard being had to the general nature of accusation against the petitioner and the period of his custody, he is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Pasraha P.S. Case No. 11 of 2018.
