JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 This is an application for grant of anticipatory bail in connection with Balrampur P. S. Case No. 40 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
There is recovery of huge quantity of liquor from the Safari Car and the person arrested at the spot disclosed the name of the petitioner also as the owner of the Safari Car and he was driving the said car.
Submission of the learned counsel for the petitioner is that he is not the owner of the Safari Car. The allegation is false and concocted.
Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail on the ground that at present there are allegation against this petitioner, as such, this application is not

Having heard both sides, in view of the allegation and the quantity of the liquor recovered from the Safari Car, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender and pray for regular bail before the learned court below.
