2. The petitioners seek bail in connection with Beldaur P.S. Case No. 252 of 2024, instituted for the offences punishable under Sections 191(2), 190, 61(2), 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. Earlier vide order dated 11.04.2025, passed in Cr. Misc. No. 24221 of 2025 anticipatory bail of the petitioners was rejected by this Court.
3. The prosecution case, in short, is that, husband of the informant was surrounded and brutally assaulted by the petitioner along with other co-accused persons by means of lathi and iron rods. It is further alleged that co-accused Amit
Patna High Court CR. MISC. No.78077 of 2025(2) dt.13-11-2025 2/3 Kumar struck him on the head with a Khanti, leaving him unconscious. Despite medical treatment, he succumbed to his injuries.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. Charge-sheet has been submitted in this case. No incriminating material has been recovered from the conscious possession of the petitioners. Learned counsel for the petitioners also submits that the allegation levelled against the petitioners are general and omnibus in nature. No specific allegation of assault is attributed against the petitioners. Specific allegation of assault is levelled against co-accused, namely, Amit Kumar. It is further submitted that the petitioners were only the member of the mob. The petitioners are in custody since 17.07.2025 and have got no criminal antecedent. Other co-accused has been granted bail by this Court vide order dated 27-02-2025, passed in Cr. Misc. No. 86206 of 2024.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioners.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioners as also claim based on parity, this
Patna High Court CR. MISC. No.78077 of 2025(2) dt.13-11-2025 3/3 Court is inclined to grant bail to the petitioners.
7. Let the petitioners be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Beldaur P.S. Case No. 252 of 2024.
