Petitioner is in custody in connection with Madhuban P.S. Case No. 381 of 2015 under sections 395 and 120(B) of the Indian Penal Code and Section 17 C.L.A. Act and Sections 10,11, 13 U.P.A. Act.
In the instant case petitioner was remanded on 15.9.2017. The case was registered against unknown. Learned counsel for the petitioner submits that till date the petitioner has not been put on Test Identification Parade. He further submits that in the instant case after completion of investigation, charge-sheet was submitted against 6 persons but not against this petitioner. Though, the petitioner has criminal antecedent and he was accused in other cases but in
Patna High Court Cr.Misc. No.27693 of 2018(3) dt.03-07-2018 2/2 the peculiar facts of this case petitioner deserves bail. Considering the fact that the petitioner has remained in custody on remand in this case since 15.9.2017 and the fact that other co-accused have been granted bail by the Coordinate Benches of the Court as evident from Annexure-2, 3 and 3/A, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- IV, Motihari, East Champaran, in connection with Madhuban P.S. Case No. 381 of 2015 on the condition that the petitioner will extend full cooperation in the trial and in case the petitioner fails to appear on the date fixed in the trial without any cogent reason, the trial court would be at liberty to cancel the bail bond of the petitioner.
